Ðappellee€asked€if€the€terms€of€the€new€policy€were€the€same€as€theÏterms€of€the€prior€policy,€the€appellant's€representative€repliedÏthat€the€terms€would€be€the€same.€€However,€this€reply€was€notÏcorrect,€since€the€policy€as€to€the€dividends€had€changed.€€After€theÏfirst€audit€of€the€worker's€Ô_Ôcompensation€policy,€the€appellant€hadÏcredited€the€appellee€with€$94,000€in€dividends,€but€since€the€newÏprocedure€allowed€for€negative€adjustments€to€the€dividends,€theÏappellant€had€withdrawn€the€entire€amount.€€The€appellant€sued€forÏpremiums€which€the€appellee€refused€to€pay€because€all€of€theÏdividends€had€been€withdrawn.€€The€appellee€filed€an€answer€with€aÏgeneral€denial€(which€most€answers€contain)€and€asserted€everyÏaffirmative€defense€as€set€forth€in€Rule€2„323€that€might€beÏapplicable€to€a€contract€action.€€The€appellant€filed€a€motion€forÏsummary€judgment,€and€the€appellee€intimated€in€his€response€that€itÏwas€not€necessary€to€prove€fraud,€since€he€could€argue€that€theÏappellant€negligently€misrepresented€the€insurance€policy.€€However,Ïthe€defense€of€negligent€misrepresentation€had€not€been€in€theÏappellee's€answer.€€The€appellee€filed€a€counterclaim€in€the€amountÏof€$94,000€for€breach€of€contract.€€€The€jury€found€in€favor€of€theÏappellant€for€the€unpaid€premiums€and€in€favor€of€the€appellee€forÏthe€breach€of€contract.€€The€jury€also€found€that€there€had€beenÏnegligent€misrepresentation€on€the€part€of€the€appellant.€€The€trialÏjudge€struck€the€verdict€in€favor€of€the€appellant€because€the€juryÏhad€found€negligent€misrepresentation.€€On€appeal€to€the€Court€ofÐ L-œ(. Ðthe€IOLTA€Rules€in€Maryland€about€18€months€ago€which€restricted€bankÏcharges,€and€the€program€was€able€to€increase€its€revenues.€€TheÏmonies€go€to€30€different€provider€organizations,€including€the€LegalÏAid€Bureau€and€the€House€of€Ruth.€€Maryland€has€been€a€role€model€inÏIOLTA€programs€throughout€the€country.€€The€annual€report€reflectsÏthe€range€of€organizations€which€benefit€from€the€program,€and€howÏthe€monies€are€to€be€distributed€in€the€upcoming€fiscal€year.€€TheÏlegislature€has€just€enacted€a€bill€that€allows€a€ten„dollarÏsurcharge€on€each€civil€circuit€court€and€a€two„dollar€surcharge€onÏeach€civil€District€Court€case€filed.€€This€legislation€willÏdramatically€increase€the€amount€of€funds€available€to€the€providerÏorganziations.€€Mr.€Garten€expressed€his€appreciation€to€DelegateÏVallario€and€the€other€legislators€who€were€very€helpful€in€gettingÏthis€bill€passed.€€IOLTA,€however,€remains€the€single€most€importantÏsource€of€revenue€for€the€Legal€Services€Corporation.€€ProviderÏorganizations€are€encouraged€to€do€their€own€fundraising.€€However,Ïonly€25%€of€the€people€who€require€legal€services€are€being€reached.€ÏThe€decision€of€the€Supreme€Court€is€a€potential€bombshell€for€theÏprogram.€€€The€people€who€operate€the€Texas€program€put€in€anÏenormous€amount€of€time€on€it€and€feel€very€good€about€the€program.€ÏMr.€Garten€said€that€those€who€work€with€the€IOLTA€programs€areÏoptimistic€about€them,€since€the€Supreme€Court€only€considered€oneÏprong€of€the€formula.€€The€other€two€prongs€were€left€for€furtherÏdiscussion,€and€the€case€may€not€be€back€to€the€Supreme€Court€for€twoÐ L-œ(.
