Ðextrinsic€sources€about€the€warning.€€One€rational€construction€wouldÏbe€to€notify€the€complainant€but€with€only€a€"bare€bones"Ïexplanation.€€The€Commission€has€not€notified€the€complainant€in€allÏcases.Ìà  àJudge€Harrell€told€the€Committee€that€the€Commission€does€notÏlike€either€of€the€alternatives€presented€in€subsection€(a)(2).€€OneÏconcern€is€that€if€the€rejection€of€the€warning€causes€the€judge€toÏbe€charged,€it€forces€the€Commission€into€a€dilemma.€€The€charge€mayÏhave€been€sanctionable€conduct€which€is€not€likely€to€be€repeated,Ïand€the€Commission€may€be€concerned€about€charging€the€judge.€€TheÏability€to€reject€the€warning€also€takes€away€the€discretion€of€theÏCommission.€€The€warning€is€designed€to€give€guidance€to€a€judge€whoÏmay€have€skated€near€or€crossed€over€the€edge€of€inappropriateÏbehavior.€€Rejecting€the€warning€removes€the€Commission's€discretion.Ìà  àMr.€Brault€commented€if€a€question€on€an€application€forÏjudicial€office€asks€about€prior€discipline€and€the€judge€correctlyÏstates€that€the€judge€was€never€disciplined,€if€the€nominatingÏcommission€learns€from€an€outside€source€that€the€judge€received€aÏdismissal€with€a€warning,€the€inference€would€not€be€favorable.€ÏAlternatively,€the€question€may€be€couched€as€"has€there€ever€been€aÏcomplaint€made€against€you?"€€In€this€case,€the€fact€that€a€warningÏis€not€discipline€makes€no€difference.€€The€judge€must€disclose€theÏwarning.€€Judge€Harrell€said€that€he€had€not€looked€at€a€judicialÏapplication€form€for€eight€years,€and€he€did€not€recall€the€form€ofÐ L-œ(. Ðthe€question.€€Mr.€Brault€observed€that€in€his€experience€with€theÏjudicial€nominating€process,€the€applicants€always€relate€everyÏdetail€of€all€complaints€made€against€them.€€The€Rules€CommitteeÏwrestled€with€this€issue€in€the€discussion€of€the€Attorney€DisciplineÏRules.€€Judge€McAuliffe€did€not€like€the€fact€that€the€JudicialÏDisabilities€Commission€rules€provide€no€opportunity€to€appeal€from€aÏwarning.€€Often€applications€for€malpractice€insurance€ask€aboutÏcomplaints€made€against€the€applicant.€€Mr.€Howell€remarked€that€theÏwarning€is€supposed€to€be€used€as€guidance€for€the€judge,€but€it€doesÏnot€always€work€as€it€should.€€Judges€are€public€figures,€and€oftenÏthere€is€vast€media€coverage€when€the€complainant€learns€of€aÏwarning.€€In€one€recent€case€that€was€dismissed€with€a€warning,€theÏmedia€correctly€reported€that€disposition€but€then€went€on€to€repeatÏall€of€the€allegations€against€the€judge,€even€allegations€that€wereÏunfounded.€€Most€judges€appreciate€the€guidance€when€they€step€nearÏto€or€over€the€line.€€As€between€a€choice€of€receiving€a€warning€orÏbeing€the€subject€to€proceedings€that€could€result€in€a€reprimand,Ïmost€judges€would€choose€the€warning.€€A€judge€may€be€covered€by€theÏmedia€on€a€daily€basis.€€A€judge€may€be€denied€his€or€her€day€inÏcourt€without€the€opportunity€to€prove€unfounded€charges.Ìà  àMr.€Boarman€was€the€next€speaker.€€He€thanked€the€RulesÏCommittee€for€the€opportunity€to€appear.€€He€thanked€the€Chair€forÏhis€appearance€at€the€previous€Commission€meeting.€€He€said€that€allÏof€the€Commission€members€are€in€agreement€as€to€the€criticisms€ofÐ L-œ(. Ðthe€proposed€amendments.€€They€are€a€dedicated€group€of€individualsÏwith€no€axes€to€grind€and€no€agenda.€€Their€goal€is€to€ensure€thatÏthe€public€respects€the€judiciary.€€By€changing€Rule€16„807,€theÏCommittee€is€proposing€to€take€away€the€Commission's€best€tool.€€TheÏCommission€strives€to€be€fair€to€judges€and€to€complainants,€and€toÏhonor€its€confidentiality.€€The€confidentiality€requirements€may€hurtÏthe€Commission,€because€it€cannot€discuss€any€matter€which€is€notÏpublic.€€When€only€one€side€of€the€Commission's€actions€are€heard,€itÏis€difficult€to€make€a€judgment€about€their€decisions.€Ìà  àMr.€Boarman€commented€that€the€Commission€is€very€aware€of€theÏpossible€damage€that€a€charge€to€a€sitting€judge€can€be€to€theÏjudge's€future€career.€€The€Commission€ensures€the€fairest€possibleÏresult.€€All€of€the€Commission€members€respect€the€position€of€judge.€ÏThey€balance€the€rights€of€citizens€with€the€rights€of€judges.€€Mr.ÏBoarman€urged€the€Committee€not€to€tamper€with€the€Commission'sÏauthority€to€dismiss€with€a€warning.€€The€Rule€as€it€exists€now€worksÏvery€well.€€If€it€is€changed,€it€would€be€more€difficult€to€dismissÏcases,€and€the€change€could€have€the€opposite€effect€of€what€isÏintended.€€Also,€the€proposal€to€change€the€definition€of€the€termÏ"sanctionable€conduct"€would€be€harmful€to€the€judicial€disciplineÏprocess.€€It€would€restrict€the€Commission€and€be€harmful€to€theÏpublic.€€There€is€no€reason€to€make€the€change.Ìà  àMr.€Howell€asked€what€the€harm€would€be€to€allow€a€judge€toÏconsider€a€proposed€warning€and€have€the€opportunity€to€consent€to€itÐ L-œ(. Ðhave€been€better€off€explaining€about€the€dismissal€with€a€warning.€ÏThe€Chair€stated€that€if€he,€as€the€trial€judge,€were€the€subject€ofÏa€complaint€by€the€mother„in„law€of€a€party€litigant,€and€he€feltÏthat€he€had€done€nothing€wrong,€and€he€did€not€want€the€warning,€heÏshould€have€the€opportunity€to€argue€the€warning.Ìà  àThe€Vice€Chair€raised€again€the€question€of€why€the€judgeÏshould€be€in€a€better€position€than€the€attorney.€€Mr.€Brault€notedÏthat€in€the€Attorney€Discipline€Rules,€there€are€two€levels€ofÏwarnings.€€The€first€warning€is€by€Bar€Counsel.€€This€is€informal€andÏthe€in„house€grievance€rules€set€out€the€procedure.€€The€secondÏwarning€is€the€more€powerful€one€„„€the€hearing€panel€can€dismiss€theÏcase€with€a€warning.€€Ìà  àMr.€Brault€suggested€that€Mr.€Boarman's€written€remarks€be€madeÏpart€of€the€record€of€today's€meeting.€€The€Committee€agreed€byÏconsensus€to€this€suggestion.€€(See€Appendix€1).€€Mr.€BraultÏcommented€that€in€his€experience€with€attorney€discipline,€anÏattorney€who€rejects€a€warning€will€be€charged.€€A€judge€who€comesÏbefore€the€nominating€commission€and€reports€a€dismissal€with€aÏwarning€can€argue€articulately€that€he€or€she€did€not€have€theÏopportunity€to€reject€the€warning.€€This€will€cause€a€problem€only€onÏrare€occasions.€€Judge€McAuliffe€said€that€he€would€not€want€the€ruleÏto€be€written€to€allow€a€body€to€issue€a€warning€without€the€abilityÏof€the€judge€to€be€able€to€reject€or€appeal€the€warning.€€This€wouldÏbe€unfair,€and€it€would€be€a€major€stigma€for€the€judge.€€The€powerÐ L-œ(. Ðof€the€Commission€to€issue€a€dismissal€with€a€warning€is€invaluable,Ïand€999€of€1000€judges€would€accept€the€warning.€€In€the€rare€case,Ïif€the€judge€disagrees€with€the€warning,€any€judge€will€know€that€aÏrejection€of€the€warning€will€result€in€a€charge.€€Judge€McAuliffeÏexpressed€the€opinion€that€Alternative€2€is€the€better€option.€€Mr.ÏHowell€added€that€the€Subcommittee's€position€was€that€if€a€judgeÏrejected€a€warning,€the€judge€is€ñgñ¢ñgñestoppedñgñ£ñgñ€in€any€later€proceedingÏfrom€using€the€fact€that€a€dismissal€was€offered.Ìà  àMr.€Sykes€remarked€that€in€certain€cases€where€the€CommissionÏdismisses€without€a€warning,€it€might€be€beneficial€for€theÏCommission€to€hold€an€informal,€off„the„record€counseling€sessionÏwith€the€judge.€€Mr.€Hochberg€asked€if€the€word€"warning"€could€beÏchanged€to€the€word€"advice."€€A€dismissal€could€be€entered,€theÏadvice€given,€and€the€case€closed.€€The€Chair€reiterated€that€judgesÏhave€been€destroyed€by€the€media.€€Ìà  àMrs.€Beims€told€the€Committee€that€it€might€be€helpful€if€theyÏunderstood€how€the€Commission€decides€about€the€warning.€€If€a€judgeÏhas€stepped€over€the€line,€in€95%€of€the€cases,€a€warning€is€issued.ÏThe€judge€is€invited€to€an€informal€meeting€to€which€he€or€she€may€orÏmay€not€bring€an€attorney.€€The€process€used€is€very€fair.€€TheÏCommission€members€ask€the€judge€questions.€€The€matter€may€end€in€aÏdismissal,€but€if€the€Commission€concludes€the€issues€are€veryÏimportant,€the€case€will€not€be€dismissed.Ìà  àMs.€Knox€inquired€as€to€what€the€next€step€would€be€in€theÐ L-œ(. Ðprocess€if€the€judge€rejects€the€warning.€€Would€there€be€anotherÏmeeting€with€the€Commission?€€The€Chair€answered€that€the€ball€wouldÏbe€back€in€the€Commission's€court,€and€the€Commission€could€proceedÏany€way€it€wished.€€Judge€Adkins€commented€that€the€Commission€wouldÏnot€necessarily€charge€the€judge€after€a€rejection€of€the€warning.€ÏOften€their€preference€is€to€provide€guidance€to€the€judge.€€They€mayÏnot€be€happy€about€the€rejection,€but€they€still€might€decide€not€toÏproceed.Ìà  àMr.€Karceski€questioned€as€to€Judge€Smith's€and€Judge€Baldwin'sÏopinions€on€the€proposed€amendments.€€Judge€Smith€said€that€theÏjudicial€discipline€process€is€an€evolving€one.€€It€is€differentÏtoday€than€it€was€in€1973.€€In€prior€years,€there€was€moreÏinformality€and€more€opportunity€for€the€Commission€to€counselÏjudges.€€The€concept€today€is€to€maintain€the€high€quality€of€theÏjudiciary,€leaving€judges€the€independence€necessary€to€makeÏdifficult€decisions.€€It€is€important€for€the€public€to€be€confidentÏas€to€the€high€quality€of€the€judiciary.€€It€is€the€charge€of€theÏJudicial€Disabilities€Commission€to€do€that.€€It€is€equally€importantÏthat€judges€have€confidence€in€the€Judicial€Disabilities€CommissionÏRules.€€Even€though€many€judges€have€never€been€in€front€of€theÏCommission,€many€judges€are€concerned€about€the€Rules.€€One€issue€isÏthe€definition€of€"sanctionable€conduct."€€Judges€care€whether€theyÏare€brought€before€the€Commission€or€their€colleagues€are.€€Some€ofÏthe€judges'€concerns€affect€the€independence€of€the€judiciary,Ð L-œ(. ÐCommission.€€Ìà  àJudge€Adkins€noted€another€example€of€the€weakness€of€theÏMaryland€Canons.€€The€second€sentence€of€Canon€ñgñ¢ñgñ2Bñgñ£ñgñ€states€"[a]€judgeÏshould€not€use€the€prestige€of€judicial€office€to€advance€the€privateÏinterests€of€others;€nor€should€a€judge€convey€or€permit€others€toÏconvey€the€impression€that€they€are€in€a€special€position€toÏinfluence€judicial€conduct."€€If€a€judge€were€to€go€to€the€clerk€ofÏcourt€in€a€county€and€request€a€job€for€the€judge's€nephew,Ïpressuring€the€clerk€of€court,€that€would€be€conduct€the€CommissionÏshould€look€into.€€However,€Canon€ñgñ¢ñgñ2Bñgñ£ñgñ€is€not€mandatory.€€Ìà  àJudge€Adkins€said€that€subsection€(h)(2)(C)€overlaps€withÏsubsection€(h)(2)(D).€€The€matter€of€the€bias€of€a€judge€is€coveredÏin€Canon€ñgñ¢ñgñ3Añgñ£ñgñ(9).€€It€is€one€of€the€few€mandatory€statements.€ÏPresumably,€the€Subcommittee€is€recommending€that€if€the€judgeÏexhibits€bias€while€on€the€bench,€the€conduct€is€subject€toÏCommission€jurisdiction,€even€if€the€bias€is€not€bad€enough€to€makeÏthe€judge€unfit€for€office.€€Subsection€(h)(2)(C)€seems€to€indicateÏthat€the€Commission€cannot€address€the€matter€if€an€appellate€courtÏcan€consider€it.€€This€is€an€inconsistency.€€à È àJudge€Adkins€statedÐ x$È$ Ðthat€her€view€is€that€if€a€judge€showed€bias,€it€would€notÏnecessarily€mean€that€the€judge€is€unfit.€€The€"shall"€Canons€areÏmoving€further€from€the€concept€of€progressive€discipline.€€TheÏCommission€would€not€be€able€to€address€an€issue€unless€it€wereÏserious€enough€to€justify€the€removal€of€the€judge.€€This€seems€to€doÐ L-œ(.
