Mental Health

Divorce, separation, custody, visitation and child support cases can involve complex mental health issues. The Maryland circuit courts have established relationships with local mental health agencies and private providers who conduct evaluations and offer treatment.

EVALUATIONS:

A parent's mental health can affect that person's ability to care for a child. The court may also need information about the mental health of a child to identify that child's needs. In cases where the mental health of an adult or child is of concern, the court may require the individual in question to have a mental health evaluation. These are typically done by a court psychologist or private clinicians - someone who is not that person's treating psychologist. Statements made to a mental health evaluator are not considered confidential. The evaluator will usually be asked to prepare a written report of their findings, and may be required to testify in court.

The parties will usually be required to pay for the evaluation, which can be costly. If you cannot afford to pay for an evaluation, and one has been ordered, talk to your Family Support Services Coordinator to see if you qualify for a full or partial fee waiver.

TREATMENT:

In addition to mental health evaluations, courts have access to therapists and counselors who can provide therapy to families as a whole or individual members. The court can make referrals for treatment in appropriate cases. Contact the Family Support Services Coordinator in your local circuit court if you feel you need a referral for counseling services for yourself, your child or your family.
